Acceptable Use Policy

This Acceptable Use Policy ("Policy") supplements the Terms of Service of Asphalt Paving Mastery LLC ("Company," "we," "us," or "our") and addresses three specific subjects: artificial intelligence and machine learning restrictions, third-party trademark protections, and the enforcement framework we apply when violations of our Terms of Service or this Policy occur.

This Policy is incorporated by reference into our Terms of Service, available at http://asphaltpavingmastery.com/terms-of-service. The full list of prohibited activities is set forth in the Terms of Service. This Policy does not duplicate those provisions; instead, it adds further restrictions and describes how we respond to violations. Capitalized terms used but not defined in this Policy have the meanings given to them in the Terms of Service.

If you do not agree with our Terms of Service or this Policy, you must not use our Services. Your continued use of our Services constitutes acceptance of this Policy.

WHO WE ARE

1. ARTIFICIAL INTELLIGENCE AND MACHINE LEARNING RESTRICTIONS

Important: Our Content represents substantial investment in curriculum development, technical writing, narration production, video production, and original illustration. Use of our Content as input or source material for artificial intelligence and machine learning systems extracts value from that investment in ways that go beyond the limited streaming license granted under our Terms of Service. This Section sets forth the additional restrictions that apply to artificial intelligence and machine learning use.

Prohibited AI and Machine Learning Uses

Without our express prior written authorization, you may NOT use any of our Content for any of the following purposes:

• Training, fine-tuning, or pre-training any artificial intelligence system, machine learning model, neural network, large language model, multimodal model, foundation model, or any similar technology;
• Generating training datasets, validation datasets, or evaluation datasets derived in whole or in part from our Content, regardless of whether such datasets are used by you or shared with any third party;
• Generating embeddings, vectors, or other numerical representations of our Content for retrieval-augmented generation ("RAG") systems, semantic search systems, vector databases, or any other artificial intelligence application;
• Building, training, or operating retrieval-augmented generation systems that incorporate our Content as a knowledge source, reference corpus, or retrieval index;
• Generating, transcribing, summarizing, paraphrasing, or otherwise creating derivative outputs using our Content as input to any artificial intelligence system, whether for personal, internal, or commercial use;
• Translating our Content using artificial intelligence or machine learning systems for any purpose other than your own internal accessibility use on a single authorized Device;
• Distilling, compressing, or otherwise extracting the substantive knowledge contained in our Content into any artificial intelligence model, dataset, knowledge base, or training corpus;
• Submitting our Content to any third-party artificial intelligence service, application programming interface (API), or platform for processing, analysis, generation, or any other purpose;
• Operating, deploying, or licensing any artificial intelligence system, application, product, or service that was trained on, fine-tuned with, or otherwise derived in whole or in part from our Content;
• Using web scrapers, crawlers, automated extraction tools, or browser automation to harvest our Content for any of the purposes described above.

Scope of Restrictions

For purposes of this Section, "artificial intelligence and machine learning" includes but is not limited to: large language models, generative artificial intelligence, computer vision systems, speech recognition systems, natural language processing systems, recommendation systems, neural networks of any architecture, transformer models, diffusion models, embedding models, retrieval systems, and any successor technologies. These restrictions apply regardless of whether the artificial intelligence system is proprietary or open source, commercial or non-commercial, personal or organizational.

These restrictions apply to all forms of our Content, including but not limited to: video lessons, audio narration, written transcripts, technical diagrams, illustrations, animations, slide decks, assessments, reference materials, and any other materials made available through the Services.

Express Authorization Required

If you wish to use our Content for any of the purposes described in this Section, you must obtain our express prior written authorization. Authorization requests should be directed to Support@AsphaltPavingMastery.com. We may grant or refuse authorization in our sole and absolute discretion and may condition any authorization on payment of licensing fees, execution of a separate written agreement, and other terms.

Authorization granted to any third party does not extend to any other party. Authorization granted for one purpose does not extend to any other purpose.

2. THIRD-PARTY TRADEMARK AND REFERENCE PROTECTIONS

Our Content references various third-party trademarks, including equipment manufacturers, industry organizations, regulatory agencies, and technology providers. These references are made for educational and illustrative purposes only under principles of nominative fair use, as further described in our Disclaimer.

To protect the rights of those third parties and to prevent confusion in the marketplace, you acknowledge and agree that you will not:

• Misrepresent equipment manufacturer references in our Content (including but not limited to Caterpillar, Wirtgen Group, Volvo Construction Equipment, BOMAG, HAMM, Sakai, Dynapac, Roadtec, Astec Industries, John Deere, Komatsu, Topcon, Trimble, Leica Geosystems, Weiler, and any other manufacturer referenced in our Content) as endorsements of our Services by those manufacturers;
• Use references to equipment manufacturers, technology providers, or industry product names in our Content to imply affiliation, sponsorship, partnership, certification, or endorsement;
• Misrepresent industry standard references (including but not limited to FHWA, AASHTO, NAPA, Asphalt Institute, ASTM, FAA, MUTCD, OSHA, and state Departments of Transportation) as endorsements, accreditations, or certifications of our Services by those organizations;
• Use Content references in any manner that could constitute trademark infringement, false endorsement, false designation of origin, dilution, or unfair competition against the actual trademark holders;
• Extract third-party trademarks, logos, or product references from our Content for use in your own marketing, sales materials, or commercial communications.

Any unauthorized use of third-party trademarks based on references found in our Content is solely the responsibility of the user, and we expressly disclaim any responsibility for such misuse.

3. REPORTING VIOLATIONS

We rely on Subscribers and members of the industry to help us protect our Services and our intellectual property. If you become aware of any violation of this Policy or our Terms of Service, including but not limited to:

• Unauthorized sharing of subscription credentials or access;
• Exceeding authorized Device limits;
• Unauthorized reproduction, recording, broadcasting, or distribution of our Content;
• Use of our Content in artificial intelligence training, fine-tuning, or generation systems;
• Misrepresentation of any documentation derived from the Services as a regulatory credential or certification;
• Identity fraud, impersonation of Asphalt Paving Mastery LLC, or impersonation of our personnel;
• Security vulnerabilities or attempted unauthorized access to our Services;
• Misuse of third-party trademarks based on references in our Content;
• Any other conduct that appears to violate this Policy or our Terms of Service.

Please report the violation to us at Support@AsphaltPavingMastery.com. We take violations seriously and investigate all reasonably documented reports. We may, in our discretion, maintain the confidentiality of reporters.

4. CONSEQUENCES OF VIOLATIONS

The consequences for violating this Policy or our Terms of Service will vary depending on the severity of the violation, the violator's prior history with the Services, the nature of the conduct, and the harm caused to us, other Subscribers, or third parties. We reserve the right, in our sole discretion, to take any or all of the following actions:

Warnings and Educational Responses

• Issue a written warning to the Subscriber;
• Require written acknowledgment of this Policy and the Terms of Service as a condition of continued access;
• Require remediation actions, such as removing unauthorized Devices or ceasing prohibited conduct;
• Restrict certain features or functionality of the Subscriber's account during a corrective period.

Account Actions

• Suspend the Subscriber's account temporarily;
• Terminate the Subscriber's account permanently, without refund;
• Block IP addresses, Devices, or hardware identifiers from accessing the Services;
• Refuse current and future access to the Services by the Subscriber, the Subscriber's affiliates, or any related party;
• Require additional verification, authentication, or compliance measures as a condition of continued access.

Enterprise Subscriber Actions

For violations occurring under an Enterprise Subscription Agreement, we additionally reserve the right to:

• Notify the Enterprise Subscriber's administrators of violations occurring under their account;
• Require the Enterprise Subscriber to expand their authorized Device count, pay additional fees, or take corrective action as a condition of continued service;
• Terminate the Enterprise Subscription Agreement for material violations;
• Pursue any remedies available under the Enterprise Subscription Agreement, including audit rights, liquidated damages provisions, and indemnification provisions.

Legal Actions

• Initiate legal proceedings against the violator, including the Subscriber and any individual or entity acting through the Subscriber's account;
• Pursue civil remedies including damages, statutory damages under the Copyright Act, injunctive relief, disgorgement of profits, and attorneys' fees;
• Pursue criminal complaints where violations may constitute criminal conduct under federal, state, or local law;
• Notify law enforcement authorities where we believe there is a genuine risk of harm, a threat to public safety, or evidence of criminal activity;
• Notify regulatory authorities, professional associations, employers, or industry organizations in cases involving fraud, misrepresentation of credentials, or representation that any individual has been trained through the Services when they have not;
• Cooperate fully with law enforcement investigations, court proceedings, and other legal processes.

Intellectual Property and AI-Specific Remedies

For violations involving unauthorized reproduction of our Content, unauthorized AI training or use, or other intellectual property violations, we additionally reserve the right to:

• Send takedown notices under the Digital Millennium Copyright Act ("DMCA") to platforms, hosting providers, or other intermediaries hosting infringing material;
• Demand removal or destruction of any artificial intelligence models, datasets, embeddings, or derivative works created in violation of Section 1 of this Policy;
• Pursue statutory damages under the Copyright Act for willful infringement;
• Pursue injunctive relief to prevent ongoing or threatened infringement;
• Pursue claims for breach of contract, including the recovery of any commercial value extracted from our Content through unauthorized use.

Other Actions

• Publish notices of violations where permitted by law and where doing so serves to protect Subscribers and the industry;
• Apply any liquidated damages provisions specified in applicable Enterprise Subscription Agreements;
• Take any other action we deem appropriate to address the violation and protect our Services, our Subscribers, our intellectual property, and any affected third parties.

Important: We exclude our liability for all actions taken in response to violations of this Policy or our Terms of Service. We are not obligated to take any specific action in response to any specific violation. Our decision to take or not take any particular action does not waive our right to take that action or any other action in the future, with respect to the same violation or any other violation.

5. MODIFICATIONS TO THIS POLICY

We reserve the right to modify this Policy at any time. Changes will be effective immediately upon posting to our Services with an updated "Last updated" date. Material changes will be communicated through prominent notice on our Services or by direct notification to active Subscribers where appropriate.

Your continued use of the Services after changes are posted constitutes your acceptance of the modified Policy. If you do not agree with any modifications to this Policy, you must discontinue use of the Services.

Acknowledgment.
